Mark Andrew Gomez, on this second annual return, reported $105,081.91 in
income, and expenditures of $105,043.61, leaving a “net income” of $38.30. 
8.3.3
The annual return states that he had assets of $163,487.57 (Edward D. Jones
brokerage account, $71,243.63; checking accounts, $12,243.94; and the House on
Laurel Drive, $80,000.00) on hand at the end of the period.  After restatement, the
ending assets should have been $250,068.58  (cash in checking accounts $99,744.41;
Edward D. Jones brokerage account, $70,324.17; and House on Laurel Drive,
$80,000.00) These restatements are shown in the spreadsheet at 8.3.8.
8.3.4
Of greater significance than the accounting misstatements are the following
items, which are a part of the RICO Enterprise conduct of Mark Andrew Gomez and
the Other Racketeering Defendants. This RICO Enterprise conduct is as follows.
8.3.4.1 Mark Andrew Gomez purchased a used computer for $1,093.00 from
Knight, Stemberger, and Gomez. The purchase price of the computer was
excessive and the computer was used for Mark Andrew Gomez’s law practice.
8.3.4.2 
The Racketeering Lawyer/former Guardian made payments of
$2,507.94 for mileage and miscellaneous reimbursements to caretakers after the
time that McIntosh Management assumed responsibility for the caretaking of
Gary Wayne Thompson.
8.3.4.3 
The Racketeering Lawyer/former Guardian made a payment of
$5,795.09 for caretaker payroll after the date that McIntosh Management assumed
responsibility for the caretaking of Gary Wayne Thompson.
