Racketeering Defendants were contractually and legally obligated to perform for
Gary Wayne Thompson. This division of allegiance by Mark Andrew Gomez and the
Other Racketeering Defendants enhanced the damages to Gary Wayne Thompson.

Examples of this type of conduct and damages caused thereby during Period
Three are identified as follows.
8.4.7.1 
Mark Andrew Gomez paid $1,228.20 for physical rehabilitation for
Gary Wayne Thompson. These medical claims could have been filed with the
Gary Wayne Thompson’s insurance carrier, but were not.
8.4.7.2 
Mark Andrew Gomez paid Merry Maids (cleaning service) twice on
the same date, January 28, 1998. The timing is an issue because a different
cleaning service was paid for the preceding month.
8.4.8
Period Three Summary   At the end of Period Three, Gary Wayne
Thompson should have had total assets of $334,998.00, but had only $189,352.42, a
difference of $145,645.58. The restated ending assets of $334,998.00 consist of
checking accounts, $168,788.92; Edward D. Jones brokerage account, $71,209.08;
House on Laurel Drive, $80,000.00; and the 1994 Lexus ES300, $15,000.00.
