Procedural Background
The Probate Court Appeal, Civil Action File No. 00-V-331 (or “Probate Appeal”)
The first styled matter here is before the Court in connection with a
de novo
appeal from the Probate Court of Coweta County to the Superior Court of Coweta
County by Rhonda McClendon, as the successor guardian of the Estate of Gary Wayne
Thompson (or “Rhonda McClendon, as Guardian”). That appeal by Rhonda
McClendon, as Guardian is from adverse rulings to caveats and objections made to the
final return, application for letters dismission, and the overall administration of the
Estate of Gary Wayne Thompson by his former guardian, Mark Andrew Gomez.
The Civil Action Civil Action, File No. 2001-SU-V-68 (or “Civil Action”)
In addition to the Probate Appeal, this matter is before the Court in connection
with a complaint by Rhonda McClendon, as Guardian of the Estate of Gary Wayne
Thompson, against Mark Andrew Gomez and other parties to this proceeding. This
Complaint
was primarily based upon Georgia Racketeer Influenced and Corrupt
Organizations Act O.C.G.A. §16-14-1, et seq. (or, “RICO”) causes of action. The Complaint
made allegations of fraud, corruption and breach of fiduciary duties.
There is a pending motion in the
Civil Action
by Rhonda McClendon, as
guardian,
to add Hartford Fire Insurance Company (or, “Hartford”) as a party to the
case.  For purposes of judicial economy and efficiency, Hartford Fire Insurance
Company consents to its addition as a party to these proceedings, and waives formal
service of process.
