a judgment debtor has not been paid. Upon such the filing of such affidavit in the
Superior Court of Coweta County and the mailing of a copy of such affidavit by
Certified U. S. Mail, or a similar
replacement service of the U. S. Post Office, to the
judgment debtor, Mark Andrew Gomez at 67 LaGrange Street, Newnan, Georgia or at
such other address as he may designate, via certified mail, return receipt requested or
similar proof of delivery or attempted delivery, if no evidence of timely payment has
been presented under oath to the Superior Court of Coweta County within ten (10) days
from the mailing of a copy of the affidavit, a writ of fieri facias for the appropriate
amount remaining due by such judgment debtor shall issue against the party owing the
sum stated in the affidavit.
IT IS HEREBY FURTHER ORDERED, ADJUDGED, AND DECREED that in
connection with the settlement agreement of the parties, Mark Andrew Gomez, Leigh
Ann Ware, Jaime Robertson, Bret Robertson and Derwin Ware will have no liability or
other indemnity obligation to Hartford Fire Insurance Company in connection with
claims by the Estate of Gary Wayne Thompson or parties interested therein.
IT IS HEREBY FURTHER ORDERED, ADJUDGED, AND DECREED that
upon payment of all the sums by Hartford and Mark Andrew Gomez all of Mark
Andrew Gomez’ obligations to the Estate of Gary Wayne Thompson shall be discharged
and no other claims by the Estate against Mark Andrew Gomez
shall be viable, unless
created after this judgment.
